Terms and conditions
Article 1 (Purpose)
The purpose of this Agreement is to prescribe the rights, obligations, and responsibilities of the cyber mall and users in using the Internet-related services (hereinafter referred to as the “service”) provided by the ULINet Cyber Mall (hereinafter referred to as the “mall”) operated by the Sowon Web Company (e-commerce operator).
※ “These terms and conditions shall also apply mutatis mutandis to e-commerce using PC communication, wireless, etc. as long as they are not contrary to their nature.”
Article 2 (Definition)
① The term “mall” means a virtual place of business established by a Wish Web company to trade goods, etc. using information and communication facilities such as computers in order to provide goods or services (hereinafter referred to as “goods, etc.”) to users, and is also used as the meaning of a business operator operating a cyber mall.
② The term “user” means a member and non-member who accesses the “Mall” and receives the services provided by the “Mall” under these terms and conditions.
③ The term “member” means a person who has registered as a member in the “mall” and who can continuously use the services provided by the “mall”.
④ The term “non-member” refers to a person who does not join a member and uses the services provided by the “mall”.
Article 3 (Specification, explanation, and revision of terms and conditions, etc.)
① The “Mall” shall post the contents of these terms and conditions, trade name and representative name, address of the business office (including address where consumer complaints can be handled), phone number, imitation transmission number, e-mail address, business registration number, mail order business registration number, personal information management manager, etc. on the initial service screen (front) of the 00 Cyber Mall. However, the contents of the terms and conditions can be viewed by users through the connection screen.
② “Before users agree to the terms and conditions, the mall should provide a separate connection screen or pop-up screen so that users can understand important contents such as withdrawal of subscription, delivery responsibility, and refund conditions.”
③ The “Mall” may amend these terms and conditions to the extent that they do not violate the relevant laws, such as the Consumer Protection Act in Electronic Commerce, the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Information and Communication Network Utilization Promotion and Information Protection Act, the Door-to-Door Sales Act, the Framework Act on Consumers, etc.
④ When “Mall” revises the terms and conditions, it shall be notified on the initial screen of the mall from seven days before the date of application to the day before the date of application, specifying the date of application and the reason for the revision. Provided, That if the contents of the terms and conditions are changed unfavorably to the user, it shall be notified with a minimum grace period of at least 30 days. In such cases, “Mall” shall clearly compare the contents before the revision and the contents after the revision and display them in an easy way for the user to understand.
⑤ If “Mall” revises the terms and conditions, the revised terms and conditions apply only to contracts concluded after the application date, and for contracts already concluded before that date, the terms and conditions before the revision apply as they are. However, if a user who has already signed a contract transmits the intention to be subject to the revised terms and conditions to “Mall” within the notice period of the revised terms and conditions under paragraph (3) and obtains the consent of “Mall”, the revised terms and conditions apply.
⑥ Matters not prescribed in these Terms and Conditions and the interpretation of these terms and conditions shall be governed by the Consumer Protection Act in Electronic Commerce, the Regulation of Terms and Conditions, and the guidelines for consumer protection in electronic commerce and related laws or regulations prescribed by the Fair Trade Commission.
Article 4 (Provisions and modifications of services)
① “Mall” performs the following tasks.
- Provision of information on goods or services and conclusion of a purchase contract
- Delivery of goods or services to which a purchase contract has been signed
- Other tasks prescribed by the “Mall”
② The “Mall” may change the contents of goods or services to be provided by a contract to be concluded in the future in the event of out of stock of goods or services, changes in technical specifications, etc. In such cases, the contents of the changed goods or services and the date of provision shall be immediately notified where the current goods or services are posted, specifying the changed contents and date of provision.
③ If the contents of the service contracted with the user to be provided by the “Mall” are changed due to the sale of goods, etc. or changes in technical specifications, the reason shall be immediately notified to the user at an address that can be notified.
④ In the case of the preceding paragraph, “Mall” shall compensate the user for the damage caused by this: Provided, That this shall not apply where “Mall” proves that there is no intention or negligence.
Article 5 (Suspension of Service)
① The “Mall” may temporarily suspend the provision of services in the event of maintenance inspection, replacement, failure, or loss of communication of information and communication facilities such as computers.
② The “Mall” shall compensate for damages incurred by the user or a third party due to the temporary suspension of the provision of the service due to the reasons under paragraph (1). Provided, That this shall not apply where the “Mall” proves that there is no intention or negligence.
③ Where it is impracticable to provide services due to the transition of business items, abandonment of business, integration among enterprises, etc., the “Mall” shall notify the user by the method prescribed in Article 8 and compensate the consumer according to the conditions originally set forth in the “Mall”: Provided, That where the “Mall” fails to notify the standards for compensation, etc., the mileage, reserves, etc. of users shall be paid to the user in kind or cash equivalent to the currency value used in the “Mall”.
Article 6 (Membership)
① The user applies for membership by expressing his or her consent to these terms and conditions after filling in his or her membership information according to the registration form set by “Mall”.
② The “Mall” shall be registered as a member unless it falls under any of the following subparagraphs among users who have applied for membership as in paragraph (1).
- Where an applicant for membership has previously lost his/her membership pursuant to Article 7 (3) of these Terms and Conditions, Provided, That the foregoing shall not apply where three years have passed since the loss of membership under Article 7 (3) and he/she has obtained the consent to rejoin the “Mall”.
- If there is false, missing entries, or misrepresentation in the registration details
- In other cases where it is deemed that registration as a member is significantly hindered by the description of the “mall”
③ The time when the membership contract is established is when the consent of “Mall” reaches the member.
